About the Department

 Department of Theory and History of State and Law was created as a structural subdivision of the Law Institute of Ternopil Academy of National Economy in June 1997, and on November 30, 1998, in accordance with the order № 346 at the initiative of the rector, with the aim to improve the staffing of the legal institute of Ternopil Academy of National Economy and to improve the quality of the theoretical training of future lawyers, there was made the reorganization. As a result there were created two departments: the Department of Theory of State and Law under the direction of docent Kravchuk M.V. and the Department of History of State and Law, headed by docent Y.V. Punkiv.

For eight years, the Department of Theory of State and Law has developed eight training courses, published more than 30 educational, educational and methodological materials, organized and published five issues of the scientific publication "Actual problems of jurisprudence".

Since January 1, 2006, the Departments of History and Theory were reunited again into a single structural unit - the Department of Theory and History of State and Law, headed by the PhD in Law, docent Mykola Kravchuk, who is still effectively managing a team with a significant scientific potential (1 doctor of sciences, 6 PhD of sciences, 1 senior teacher), under the guidance of the head of the department there were trained two candidates of legal sciences.

To date, the following disciplines (including in the English version) have been developed, tested and equipped with teaching materials:

Theory of state and law;

History of the state and the law of foreign countries;

History of the State and Law of Ukraine (incl. Customary law);

History of state and law of Ukraine and foreign countries;

Legal deontology and professional ethics;

Logic for lawyers;

Philosophy of law;

Problems of the theory of state and law;

Legal systems of modern times;

History of the doctrines of the state and law;

History of political and legal opinion of Ukraine;

Judicial rhetoric;

Roman law;

Canon law;

Methodology of legal research;

Methodology of research in international law;

Legal conflictology;

Research and foundations of academic integrity;

Jurisprudence.

In order to strengthen the practical training of future lawyers, there was organized the Ternopil City Public Organization "Aquitas" in 2006 on the initiative of the Head of the Department and during 2006-2010 there were functioning the Ternopil Law Clinic.

The priority direction of the department is the scientific work. So, during the functioning of the department, the teachers worked on developing research topics that were carried out at the second half of the working day. Currently, the research is being conducted on the topic: "Trends in the development of the state and the law of Ukraine (XX - the second quarter of the XXI century)" (state registration number 0117U000144, approved for 2017-2021 years). In addition, the majority of the teachers of the department have fixed themes of doctoral dissertations. Great attention of the staff of the department is paid to the monograph edition.

Moreover, the staff of the Department of THSL successfully prepares doctors of philosophy in the field of law and conducts the research work of five post-graduate students.

The key task of the teachers of the department is to increase the scientific training of students, a combination of theoretical knowledge and practical training. With this aim there were created four scientific circles (problem research groups):

the theory of state and law, problems of the theory of state and law (supervised by docent M.V. Kravchuk, V.M. Kravchuk, A.V. Baran); on the philosophy of law and the history of doctrines about the state and law (docent T. Podkovenko); the history of the state and the law of Ukraine, the customary law, Canon law (supervisor, docent V.Z. Ukhach); the history of the state and the rights of foreign countries (docent A.V. Hrubinko).

In order to learn the knowledge and approbate scientific developments in the field of jurisprudence, the teachers of the department organize and constantly hold round tables, conferences, Internet conferences, competitions, etc. This activity is aimed at increasing the level of knowledge, skills and abilities of students of the Faculty of Law, the introduction of the element of science in the educational process of law students. In this regard, on March 11, 2017, there was held All-Ukrainian Round Table devoted to the 100th anniversary of the Ukrainian Central Rada (The Central Council of Ukraine) on the theme: "UCR - the light of the national state-building: historical and legal lessons and modern realities".

Also, the staff of the department is working on the development of self-supporting scientific research topics, in particular: "The principle of legality in the construction industry," and others. The department closely cooperates with territorial communities of local self-government organizations in providing various organizational and legal services to them.

Also, the staff of the department considers the establishment of cooperation with law enforcement bodies and state authorities and government as the another important direction of its activity. This area of work involves the development and implementation of joint programs in the theory and practice of jurisprudence (including the state budget), the involvement of experienced lawyers practitioners in scientific and teaching work.

The department supports partners' scientific and professional relations with similar departments of leading universities of Ukraine: with the Department of the theory of state and law of the Odessa National Law Academy; the head of the department is Doctor of Law, Professor Y.M. Oborotov; with the Department of State History, Law and Political-Law doctrines of I. Franko Lviv National University, the head of the department is Professor Boiko I.Y.; with the Department of Administrative, Constitutional and Financial Law of the V. Stefanyk Precarpathian National University, the head of the department is docent V. Rozvadovsky. For the cooperation with the structural units of the mentioned universities, the efforts of the staff of the department are directed at the development and implementation of joint scientific projects (joint conferences, round tables, publication of scientific publications, development and solving of actual problems of jurisprudence), which provides an increase in the efficiency of scientific and educational activities of the departments.
